Terms of Use

Rules for accessing and using the Launch'it platform.

Purpose

These Terms of Use ("Terms") define the conditions for accessing and using the Launch'it platform ("the Platform"), published by Launch'it, a French sole trader (SIREN 107 208 795), contact@launch-it.app, +33 1 85 40 02 47. They apply to every User, whether acting as a consumer or as a professional.

Definitions

  • Platform: all Launch'it services, including the management panel ("Panel"), the application programming interface ("API") and the generated launchers.
  • Panel: the web interface for configuring and managing launchers.
  • Launcher: the desktop application distributed to players, generated from a configuration defined via the Panel.
  • Account: the personal space created by the User to access the Panel.
  • Team: a group of Users sharing the management of one or more launchers.
  • User: any person holding an Account.

Acceptance of the Terms

Creating an Account and using the Platform imply full acceptance of these Terms. If the User does not accept these Terms, they must refrain from using the Platform.

Description of the service

Launch'it lets you create, configure and distribute Minecraft-oriented game launchers. Configuration is done via the Panel; launchers retrieve their configuration from the API. The Platform offers a free plan and paid plans, governed by the Terms of Sale.

Registration and account

The User undertakes to provide accurate information at registration and to keep it up to date. They are solely responsible for the confidentiality of their credentials and for any activity carried out from their Account. Any unauthorised use must be reported to the publisher without delay.

Teams and roles

A User may create a Team or be invited to one. Rights within a Team are determined by a permission system (notably owner, manage members, manage team). The Team owner is responsible for managing access and the plan applicable to the Team.

User obligations

The User undertakes to use the Platform in accordance with the law and these Terms. In particular, they shall not:

  • publish or distribute any unlawful or infringing content, or content that infringes the rights of third parties;
  • harm the operation, security or integrity of the Platform;
  • circumvent the quota, permission or billing mechanisms;
  • distribute, through launchers, content that violates Mojang/Microsoft's terms of use relating to Minecraft.

The User is solely responsible for ensuring that their launchers and the content they distribute comply with applicable rights, including copyright and the licences of mods, packs and other resources.

Team content

Launchers, files, texts, images and other content configured by Teams ("User Content") are the sole responsibility of the Team that publishes them. The publisher acts as the technical host of this content and exercises no prior editorial control. In accordance with applicable regulations, the publisher promptly removes any manifestly unlawful content validly reported to it at contact@launch-it.app.

Availability and Alpha status

Since the drafting of these Terms and to date, the Platform is in an "Alpha" development phase. As such, it is provided "as is" and "as available", without any guarantee of continuous availability or freedom from errors. Malfunctions, interruptions, data loss or changes to the service may occur. The publisher undertakes to fix anomalies brought to its attention within the shortest reasonable time. The User acknowledges and accepts this experimental nature.

Intellectual property

The Platform, its code, interface and graphic elements, excluding User Content, remain the exclusive property of the publisher. The User is granted a personal, non-exclusive and non-transferable right of use, limited to the duration of use of the service. Minecraft is a trademark of Mojang/Microsoft; Launch'it is not affiliated with it.

Personal data

The processing of the User's personal data is described in the Privacy Policy, which forms an integral part of these Terms.

Suspension and termination

The User may stop using the Platform and delete their Account at any time. The publisher may suspend or terminate a User's access, without notice in the event of a serious breach of these Terms or of use that harms the security of the Platform or the rights of third parties. The consequences of termination on ongoing subscriptions are governed by the Terms of Sale.

Limitation of liability

To the extent permitted by law, the publisher cannot be held liable for indirect damages, nor for damages resulting from the Alpha nature of the service, the use of launchers or User Content. With respect to professional Users, the publisher's liability is in any event limited to the amounts actually paid over the last twelve months. These provisions do not limit the rights granted by law to consumer Users, in particular the legal guarantee of conformity, nor the publisher's liability in the event of gross negligence or wilful misconduct.

Changes to the Terms

The publisher may amend these Terms to adapt them to changes in the service or in regulations. Users are informed of substantial changes by appropriate means. Continued use after the new Terms take effect constitutes acceptance.

Governing law and dispute resolution

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the consumer User may use the consumer mediator under the conditions set out in the Terms of Sale, or refer the matter to the competent court. For professional Users, any dispute falls within the jurisdiction of the courts of the publisher's registered office, save for any mandatory provision to the contrary.
