Terms of Sale
Conditions applicable to paid Launch'it subscriptions.

Purpose and scope
These Terms of Sale ("Terms of Sale") govern subscription to the paid offers of the Launch'it Platform, provided by Launch'it, a French sole trader operating under the micro-entreprise regime, SIREN 107 208 795, reachable at contact@launch-it.app and +33 1 85 40 02 47. They apply both to consumer customers and to professional customers, with certain provisions specified according to that status. Any subscription implies acceptance of these Terms of Sale.
Plans and features
Launch'it offers a free plan and several paid plans ("Plans"). Each Plan unlocks a set of modules, features and quotas (number of launchers, team seats, news, addons, storage space). The details of the Plans and their limits are presented on the Panel's subscription page and may change. When a Plan is subscribed by the owner of a Team, the corresponding capabilities apply to the whole Team.
Prices
Prices are shown in euros, all taxes included (TTC), on the subscription page. As the publisher is under the VAT exemption regime, the statement "VAT not applicable, Article 293 B of the CGI" applies and no VAT is charged: the displayed price is the amount actually paid. The amount charged is the one shown at payment via our provider Stripe. Prices may be changed at any time; the applicable price is the one in force at the time of subscription or renewal.
Order and payment
Payment is made online via Stripe, a payment service provider. No bank card data is collected or stored by the publisher. The subscription takes the form of a monthly subscription payable in advance. The order is confirmed once Stripe validates the payment.
Term, renewal and cancellation
The subscription is concluded for a one-month term, tacitly renewed each month. The customer may cancel at any time from the billing management area (Stripe customer portal). Cancellation takes effect at the end of the current paid period: the customer keeps access to the Plan until that term, then is moved back to the free plan. No refund, even pro rata, is made for the period in progress. In accordance with Articles L215-1 et seq. and L221-25 et seq. of the French Consumer Code, the consumer customer may cancel as easily as they subscribed.
Right of withdrawal
The service provided is digital content or a digital service performed immediately. At subscription, the consumer customer expressly requests immediate performance of the service and acknowledges waiving their 14-day right of withdrawal, in accordance with Article L221-28 13° of the French Consumer Code. The professional customer does not benefit from the right of withdrawal.
Alpha status and no refund
Since the drafting of these Terms and to date, Launch'it is in Alpha. The customer acknowledges subscribing in full awareness of this experimental nature: malfunctions, interruptions or limitations may occur and will be fixed within the shortest reasonable time. Consequently, and subject to the mandatory rights set out below, no refund of the subscription may be claimed solely on the grounds of such malfunctions, interruptions or changes to the service. This clause does not deprive the consumer customer of the legal guarantee of conformity nor of the other rights granted to them by mandatory law.
Legal guarantee of conformity
The consumer customer benefits from the legal guarantee of conformity applicable to digital content and services (Articles L224-25-1 et seq. of the French Consumer Code). In the event of a lack of conformity, they may obtain the service being brought into conformity or, under the conditions provided by law, a price reduction or termination of the contract. This guarantee applies independently of the Alpha clause and cannot be excluded by contract.
Payment failure
In the event of payment failure at the due date, the subscription is placed in a past-due state. A grace period may be applied, during which access to the Plan is maintained. At the end of this period, failing regularisation, the account is moved back to the free plan and the capabilities associated with the Plan are removed.
Suspension and account deletion
In the event of account deletion, whether at the customer's initiative or the publisher's in the event of a breach, the ongoing subscription is terminated immediately, without refund of the period in progress.
Limitation of liability
With respect to professional customers, the publisher's liability in connection with the subscription is limited to the amounts paid over the last twelve months and excludes indirect damages. With respect to consumer customers, none of these provisions limits the mandatory rights provided by law; the publisher's liability remains engaged under ordinary law, in particular in the event of gross negligence or wilful misconduct.
Customer service and complaints
For any question or complaint regarding a subscription, the customer may contact the publisher at contact@launch-it.app. The publisher endeavours to respond as soon as possible.
Consumer mediation
In accordance with Articles L611-1 et seq. of the French Consumer Code, the consumer customer has the right to use, free of charge, a consumer mediator for the amicable resolution of a dispute, after having sent a written complaint to the publisher and in the absence of a satisfactory response within one month. Governing law and disputes
These Terms of Sale are governed by French law. Failing amicable resolution or successful mediation, the consumer customer may refer the matter to the court of their choice under the conditions provided by law. For professional customers, any dispute falls within the exclusive jurisdiction of the courts of the publisher's registered office.
